Terms of Use

Kernly — German Language Learning App | Effective: April 18, 2026

Acceptance

By downloading, installing, or using the Kernly mobile application ("App"), you agree to these Terms of Use. If you do not agree, do not use the App.

The Service

Kernly is a German language learning application that provides practice tasks, an AI tutor, voice conversation practice, and TestDaF exam preparation. The App is developed and operated by Illia Davydiuk, an individual developer ("we", "us", "our").

Accounts

You need an account to use the App. You agree to provide accurate information and keep your password secure. You are responsible for all activity on your account. You must be at least 13 years old, or the minimum age required in your country.

Subscriptions and Payment

• Free features are available to all users. A subscription ("Kernly PRO") unlocks additional features including unlimited AI tutor use, voice chat, and TestDaF grading.
• Subscriptions are billed through your Apple ID and managed by Apple App Store in accordance with Apple's standard terms.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions in your iPhone Settings under your Apple ID → Subscriptions. Canceling stops the next renewal; your paid period remains active until it ends.
• Prices may change. We will give you reasonable notice before any price change takes effect on your subscription.
• Refunds are handled by Apple in accordance with Apple's refund policy; we cannot issue refunds directly.

Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Share your account credentials with others or use another person's account.
• Use the App to generate content that is illegal, harmful, harassing, or violates third-party rights.
• Automate, scrape, or overload the service or the AI tutor beyond normal personal use.
• Resell, sublicense, or commercially exploit the App without written permission.

AI Generated Content

Kernly uses third-party AI models (currently OpenAI) to generate tasks, grade writing, and power the tutor. AI output can contain mistakes, including incorrect grammar explanations or factual errors. Use your judgment and consult authoritative sources for critical decisions (for example, preparing for an official exam). We do not guarantee the correctness of any AI-generated content.

Intellectual Property

The App, including its design, code, text, graphics, and trademarks, is owned by Illia Davydiuk and protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

User Content

You retain ownership of any content you submit (for example, writing samples for grading, voice recordings). By submitting content, you grant us a limited license to process it through the AI service and store it to operate the App. We do not claim ownership of your learning data and do not sell it to third parties. Service Availability

We work to keep the App running reliably, but we do not guarantee uninterrupted availability. Features may be changed, added, or removed. Scheduled maintenance or third-party outages (OpenAI, Apple, hosting providers) may temporarily affect functionality.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Termination

You can stop using the App at any time and delete your account from within the App (Settings → Account → Delete account). We may suspend or terminate your access if you violate these Terms. On termination, your right to use the App ends; certain provisions (intellectual property, disclaimers, limitation of liability) survive termination.

Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the App or by email. Your continued use after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles. Any dispute will be resolved in the courts of Ukraine, except where applicable consumer law grants you the right to bring proceedings in your country of residence.
